GENERAL
1) Placing an order with Highdogs shall imply your acceptance of our general
purchasing/sales conditions, thereby your agreement with the conditions and
your commitment to observing the conditions and provisions hereunder. These
conditions shall apply to all orders and agreements with Highdogs. A derogation
from the conditions shall be allowed solely with the written agreement of Highdogs.
Both you, as a customer, and Highdogs shall acknowledge any electronic communication
and shall not deny the validity or legal effect thereof owing to the fact that
it is an electronic communication.
2) The conditions shall respect your rights as a customer and those of Highdogs
as a supplier (sales contract).
3) These sales conditions shall apply but Highdogs shall invariably be entitled
to adjust or amend these sales conditions. In the case of ongoing contracts,
the sales conditions applied shall be those applicable at the time the sale
was made.
4) Until such time as the payment has been completed, the products shall remain
in the possession of Highdogs. Solely appropriately completed order forms may
be processed, so be sure to provide a valid e-mail address and a valid telephone
number. In the event of any doubt about the accuracy of the information provided,
Highdogs shall be entitled to refuse to handle the order. Orders shall be accepted
solely once a payment has been made in full.
5) Highdogs shall be entitled to refuse orders, a part of orders or specific
customers without being required to give a reason for this action. You shall
be notified in this case.
6) The general conditions shall apply to all Highdogs products and services
and to all agreements concluded with buyers of Highdogs products and services.

8) Nothing on this site may be used by third parties without Highdogs consent.
All the rights concerning the site, the logo, texts, photographs and images
are reserved for Highdogs. The international copyrights shall apply to the entire
contents of the Highdogs website.
9) Products shall be delivered while stocks last, and should they run out we
shall get in touch with you with a view to cancelling your order, where appropriate.
Special offers shall continue as long as these products are in stock. Highdogs
may not be held liable for any damage ensuing from a product not being in stock.
10) Should Highdogs not be able to fulfil an order for whatever reason, this
shall be notified to the buyer. Highdogs shall not be required to pay any compensation
under this heading.
11) Should you provide Highdogs with data media, electronic files, software,
etc., you must guarantee that these are free of viruses and defects.
12) Highdogs may not be held liable for any inaccuracies or typing errors on
the website.
PRICES
28) The prices shown on the site are consumer prices. They are denominated in
Euro and include VAT. The costs for handling, transport, shipment, insurance
and statutory contributions are not yet featured in the prices featured on the
website.
29) Highdogs shall be also entitled after the conclusion of the agreement to
add to the price changes in the rate of taxation and/or levies if there are
adjustments to the VAT rates and excise duties that are therefore published.
30) All price information in hard copy or electronic form shall be subordinate
to the price featured on the website.
31) Highdogs may not be held liable for any typing errors, such that incorrect
information or prices are unintentionally provided. Should this nonetheless
occur contrary to customary practice, this site shall be adjusted but the buyer
shall be entitled to cancel an order when learning the correct price or correct
information.
32) Should the buyer not be based in the country of export, the buyer personally
has to pay any import duties and additional transport costs and other VAT charges.
33) In the light of suppliers adjusting their prices, Highdogs may decide at
any time to adjust the prices of future deliveries without having to provide
reasons therefor. Should the prices be adjusted in this way, a buyer who has
just forwarded an order shall be entitled to cancel the order if this is not
yet not on order with HighDogs. However, a contact shall be first made towards
this end.
34) In the case of orders over the Internet, payments can be made in various
ways: transfers or advance payments (see website for N°s).
Should you decide to pay by a transfer, the amount has to be transferred within
seven days.
The payment has to be credited to our account within seven working days, otherwise
your order shall be cancelled.
35) Shipping costs are automatically calculated.
36) Should you fail to pay within two weeks Highdogs shall be entitled to terminate
the agreement with you and refrain from concluding any further agreements with
you.
37) A composite quotation shall not oblige Highdogs to deliver a part of the
goods contained in the offer or tender against a corresponding share of the
price indicated.
38) Offers or tenders shall not automatically apply to repeat orders.
EXCHANGES,
COMPLAINTS AND RETURNS
39) When goods are delivered you are required to check if they are consistent
with what was agreed upon. If this is not the case, you should notify Highdogs
in writing within seven working days after the delivery.
40) Should the order fail to live up to your expectations, you shall be entitled,
in consultation with us, to return the product in its original packaging within
seven working days after receipt. The product should obviously not be used or
washed and any cards that were attached should still be attached. The product
has to be returned to us undamaged. We shall refuse any insufficiently stamped
or unstamped packages.
You need to enclose a copy of your proof of purchase and your bank number, plus
a letter stating the reasons for returning the good. You may also e-mail this
to us. At the latest 30 days after receiving the product, and provided it meets
all the aforementioned conditions, we shall refund you your purchase price,
minus the shipping costs. Highdogs shall not pay your return costs unless it
sends you a completely wrong order, meaning a completely different product to
the one you ordered
41) The item you wish to exchange or return has to be back in our possession
within a limited period of time, to be agreed with you when you get in touch
with us (this period shall differ according to the distance the item has to
travel).
42) Highdogs shall be required to refuse items that are damaged or that have
already been used. The items need to be sent to the following address: Groenendriesstraat
4, 2920 Kalmthout, Belgium
43) Highdogs shall not countenance any repayment unless prior consultations
have been undertaken. As soon as you get in touch with us, we shall provide
you with instructions for returning the product.
44) Should you wish to exchange the product for another more expensive one,
we shall charge solely for the shipping costs and any supplement for the product.
The amount has to reach the Highdogs account number before your order is sent.
A refund is out of the question.
45) Should your order not be returned within seven days, the goods shall be
regard as accepted without any objections.
46) You are personally responsible for returning products and Highdogs shall
not be held liable for any mishaps.
47) Special offers may not be exchanged or returned.
WARRANTY
48) Highdogs shall guarantee the quality of its products. The warranty shall
differ according to the product. For some items, such as toys, no warranty shall
be available, while the warranty period shall differ for other items. The warranty
period shall be featured on the item's packaging or instructions for use or
shall be notified to you by Highdogs. If this is not the case, this means your
item is not covered by a warranty.
49) Warranty agreements shall apply solely if Highdogs is notified about the
discovery of a fault within fourteen days in writing or by e-mail. The message
should be accompanied by a short description of the shortcoming and a copy of
the invoice. Should the fault affecting your item still be covered by the warranty,
we shall ask you to forward the product, once again with a copy of the invoice.
50) Once the item reaches us, Highdogs shall inspect the damage and decide whether
this is covered by the warranty or otherwise. If it is, Highdogs shall pay for
all the shipping costs. Consequently, we shall refund you your costs of shipping
to us, otherwise, you shall be required to pay all administration and shipping
costs, to and fro. We shall send you your items back only when the amount you
are charged for the shipping costs reaches our account in good time.
51) Highdogs shall send you an e-mail to let you know if your item can be repaired
under warranty or otherwise. If not you are at liberty to decide to have your
item repaired on your account and at your expense. Highdogs shall then make
a prior estimate of the price for the repair, including additional transport
costs.
52) If your item may not be repaired under warranty, the sum you have to pay
for the return and any repairs has to be paid into our account beforehand before
we return your item.
53) You have to e-mail us to let us know if want to have your item repaired
or otherwise, we shall answer the e-mail. Should you not wish to have the item
repaired, this e-mail shall feature only the shipping costs, which have to be
transferred to Highdogs account within seven working days after the e-mail has
been received. You item shall be returned after the payment is received. If
you do wish to have the item repaired, we shall send you an e-mail to let you
know when it has been repaired. You then need to transfer to Highdogs account
number the sum required for the repair and the shipping costs and to do so within
14 days. Should you fail to do so, we shall try to get in touch with you. Should
you fail to react, the product shall remain in our possession. Should the amount
still not have been transferred by you after one month, 5% interest shall be
charged against the sum owed. If you have still not reacted after three months,
the item shall become the property of Highdogs.
54) If all the warranty-related conditions are met, Highdogs shall repair or
replace the returned item free of charge.
55) The warranty shall not apply should you make changes to the item, when the
defects are the result of misuse, such as failing to take account of the instructions
for use or not respecting the right size. Nor shall the warranty continue to
apply to the item if it is handled extremely carelessly or with brute force.
56) Nor shall the warranty apply if Highdogs is not notified in good time about
the shortcoming/complaint, and is thus unable to inspect the complaint or repair
the item in good time.
57) Highdogs does not offer any warranty for toys.
58) If your item can no longer be repaired Highdogs may decide to replace the
item or refund a part of the purchase price you paid for it.
59) The warranty shall no longer apply if third parties make any changes to
or perform any repairs on the delivered goods. The warranty shall also be suspended
if Highdogs finds that in its opinion the product has been misused or poorly
maintained.
60) Goods returned should be sufficiently stamped.
PRIVACY
61) Highdogs shall record information you provide in a file to be used to ensure
your order can be fulfilled as quickly as possible. Solely Highdogs has access
to this file.
62) Highdogs respects your privacy, ensuring any personal information you provide
is treated as strictly confidential.
63) Highdogs shall never transfer or sell this information to third parties.
Highdogs shall make this information available to third parties solely when
they are involved in the process of fulfilling your order.
64) Our employees and third parties helping with the fulfilment of your order
are required to treat your information as strictly confidential.
65) Highdogs shall be entitled to use your e-mail address to keep you informed
of any changes to the site, campaigns and special offers. Highdogs may use your
information for its own advertising purposes. If you prefer it is not used for
this purpose, you must inform Highdogs thereof.
66) You shall be entitled to have your information corrected or deleted.
LIABILITY
67) Highdogs may not be held liable for any changes affecting the health of
a dog, child, person or any other living being as a result of the use of our
products. The risks involved in using the products shall be your responsibility
as soon as they are delivered. Highdogs may never be held liable in this respect
nor can it be required to provide any compensation.
68) The sizes/weights/recommendations, colours featured on the site are provided
solely for illustrative purposes. Highdogs may not be held liable in this respect.
FORCE
MAJEURE
69) A force majeure refers to any circumstances outside the control of Highdogs
and not attributable to its fault that could not have been foreseen when the
agreement was concluded. They are such that it is impossible for the agreement
to be observed or continue to be observed. Examples of these are: government
measures, delivery delays, strikes, poor weather conditions, stock or staff
shortages, etc.
70) In the event of a force majeure, Highdogs shall be entitled to cancel part
or all of the agreement. Highdogs may therefore terminate the fulfilment of
the obligations, without being required to provide compensation.
SUSPENSION
AND TERMINATION
71) Highdogs shall be authorised to terminate the agreement or suspend the observation
of the obligations should you fail to observe the requirements in the agreement
or do so incompletely. Highdogs shall also be entitled to terminate the agreement
when it has good reason to fear you shall not comply with the requirements.
APPLICABLE LAW
72) These sales conditions shall be governed by Belgian law and the courts of
Antwerp shall be competent to deal with disputes
